According to the civil law of the ROC ,the legal right and duty to underage children belongs to both parents .Only if one of the parents cannot exercise the right the other party may exercise the right .therefore if one of the parents died the legal right and duty of underage children belongs to another parent .
According to the ROC civil law divorced parents may negotiate their rights and obligations about their children.
If the parents agree and the social welfare organization accepts the agreement,then it will be done according to the agreement .If any of parents disagree a judge will decide what is the best for the child based on the reports made by the social workers and other important details the judge feels significant in deciding what is the best for the child .
